The Glavin Group LLC — Terms of Purchase

By purchasing the Digital Presence Audit & Strategy Session (the "Service") from The Glavin Group LLC ("Company," "we," "us"), you ("Client," "you") agree to be legally bound by these Terms of Purchase. Please read them carefully before completing your payment.
1. Scope of Service
The Service is a fixed-scope, productized digital audit. Your purchase includes exactly:
One (1) pre-recorded asynchronous video review (delivered via a shared video link).
One (1) 3-page Digital Presence Scorecard delivered in a digital format (PDF or Google Doc).
One (1) 60-minute live strategic consultation session conducted via Zoom.
Any additional copywriting, website development, technical implementation, or ongoing consulting is explicitly excluded from this purchase and requires a separate, signed Statement of Work.
2. Payment & No-Refund Policy
The total investment for the Service is $950 USD, due in full upfront at the time of booking. Because the Company immediately allocates time, blocks out its calendar, and begins the manual, proprietary research process upon receipt of your booking, all payments are strictly final, non-refundable, and non-recoverable.
3. Rescheduling & Cancellation Policy
You may reschedule your live 60-minute strategy session up to 24 hours prior to the scheduled start time using the link provided in your confirmation email. Cancellations or rescheduling requests made with less than 24 hours' notice, or failure to show up to the scheduled Zoom call within 15 minutes of the start time, will result in the forfeiture of the live call portion of the Service. No refunds or partial credits will be issued.
4. Intellectual Property
The Company retains all ownership, copyrights, and intellectual property rights in and to any frameworks, scorecards, templates, and training materials provided during the Service. You are granted a non-exclusive, non-transferable, perpetual license to use these materials solely for the internal operations of your own business. You may not resell, share, or distribute these materials to third parties.
5. Limitation of Liability & Earnings Disclaimer
The Service provides professional recommendations and strategic analysis based on industry best practices. The Company does not guarantee specific financial results, revenue increases, traffic growth, or business outcomes. Under no circumstances shall The Glavin Group LLC be liable for any direct, indirect, incidental, or consequential damages, including lost profits or business interruptions, arising out of your use or implementation of the recommendations provided.
6. Digital Accessibility Disclaimer
While the Service includes a high-level review of website user experience (UX), the Service does not constitute a formal, exhaustive, or legally binding digital accessibility audit. The Company does not guarantee or warrant that its recommendations will ensure compliance with the Americans with Disabilities Act (ADA), Section 508 of the Rehabilitation Act, the Web Content Accessibility Guidelines (WCAG), or any other local, state, or federal digital accessibility laws. Compliance with all digital accessibility laws remains the sole legal and financial responsibility of the Client.
7. Governing Law
These Terms of Purchase and any disputes arising out of them shall be governed by and construed in accordance with the laws of the State of Colorado, without regard to conflict of law principles. Any legal actions must be filed in the courts located in Colorado.
